GoPlus Terms & Conditions

This GoPlus subscription program is offered by Go Marketplace LLC, a Delaware limited liability company d/b/a GoTickets and its affiliates and related entities ("GoTickets", "we", “our” and "us").  Access and use of the GoPlus subscription program and related Services (as defined below) are provided by GoTickets to you on condition that you accept these GoPlus Terms & Conditions (“GoPlus Terms”), and by enrolling in, accessing, or otherwise using GoPlus, you agree to these GoPlus Terms.  If you do not agree to accept and abide by these GoPlus Terms, you should not enroll in or use GoPlus.

THESE GOPLUS TERMS, THE TERMS OF SERVICE, THE PRIVACY POLICY AND ALL OTHER DOCUMENTS REFERENCED HEREIN GOVERN THE RELATIONSHIP BETWEEN YOU, THE USER OF THE SERVICES ("YOU" OR “YOUR”) AND GOTICKETS WITH RESPECT TO YOUR USE OF THE GOPLUS PROGRAM AND RELATED SERVICES (COLLECTIVELY, THE “Services”).  YOU AGREE THAT THE AGREEMENT FORMED BY THESE GOPLUS TERMS IS LIKE ANY WRITTEN NEGOTIATED AGREEMENT SIGNED BY YOU, AND YOU AGREE TO BE BOUND BY, AND FULLY COMPLY WITH, ITS TERMS.  YOU REPRESENT AND WARRANT THAT YOU HAVE ALL NECESSARY RIGHTS, POWER, AND AUTHORITY TO ENTER INTO THIS AGREEMENT AND TO PERFORM AND OTHERWISE DISCHARGE ALL OF YOUR OBLIGATIONS HEREUNDER, WHETHER ON BEHALF OF YOURSELF OR ANY ENTITY THAT YOU REPRESENT. 

ARBITRATION NOTICE: These GoPlus Terms incorporate the binding arbitration provision set forth in Section 36 of our Terms of Service. Except where prohibited by applicable law, these terms require you to arbitrate disputes with us rather than resolve disputes through a jury trial or class action. By accessing or using GoPlus, you agree to give up, and you hereby waive, any rights to participate in a class action lawsuit or representative action with respect to any disputes or claims arising out of or relating to these GoPlus Terms, GoPlus, or the Services.

1. GOPLUS OVERVIEW

GoPlus is a paid, auto-renewing membership that provides eligible members with benefits on qualifying GoTickets orders, which currently include: (a) free delivery on eligible orders; (b) discounted service fees on eligible orders; and (c) periodic members-only promotions or offers made available from time to time (collectively, the “Benefits”). Eligibility for Benefits may vary by event, venue, seller, geography, category, platform, delivery method, and other factors determined by GoTickets in its sole discretion.

2. ELIGIBILITY & ENROLLMENT

To enroll, you must (a) have a valid GoTickets account; (b) be 18 years of age or older (or the age of majority in your jurisdiction); and (c) maintain a valid, chargeable payment method on file. Memberships are personal, individual, and non-transferable, and may not be shared, resold, bartered, or used for commercial purposes.

3. MEMBERSHIP FEES; BILLING; FREE TRIAL

  • Fees. The current GoPlus membership fee is $9.99 per month plus applicable taxes (the “Membership Fee”). Fees are billed monthly to the default payment method on your account and are non-refundable, except where required by law.
  • Free Trial. New members are eligible for a one-month free trial (the “Trial Period”). Unless cancelled before the end of the Trial Period, paid billing will automatically begin at the start of the next monthly cycle.
  • Changes. We may change the Membership Fee with at least 30 days’ prior notice before the start of your next billing cycle. If you do not agree to the change, you must cancel before it takes effect.

4. BENEFITS; LIMITATIONS; EXCLUSIONS

  • Eligible Orders. Benefits apply only to eligible orders as determined by GoTickets in its sole discretion. We may exclude certain events, sellers, venues, dates, categories, delivery methods, or geographies.
  • Stacking. Unless expressly stated, Benefits may not be combined with other offers, promotions, or discounts.
  • Testing. We may test or vary Benefit levels (e.g., service-fee discount %) by user, region, event, or time. Participation in a test does not entitle any user to any specific Benefit level.
  • No Cash Value. Benefits have no cash value and are non-transferable.

5. CHECKOUT ENROLLMENT OFFER

Where available, you may be offered enrollment in GoPlus at checkout to save on your current order. If you accept, applicable GoPlus savings will be applied to that order upon successful activation of your membership. If payment authorization or enrollment fails, GoPlus savings will not apply and your order total will reflect standard fees.

6. CANCELLATION

You may cancel GoPlus at any time in your account settings under “Subscription.” Cancellation takes effect at the end of the then-current billing cycle; no credits or partial refunds are provided for any unused portion of a billing period, except where required by law. If you cancel during the Trial Period, Benefits remain active until the Trial Period ends and no Membership Fee will be charged.

7. RE-SUBSCRIPTION; FREE TRIAL LIMITATION

Limit one (1) Trial Period per GoTickets account unless otherwise stated in a promotional offer. If you re-subscribe after cancellation, you will be charged immediately and no additional Trial Period will apply unless we explicitly offer one.

8. CHANGES; SUSPENSION; TERMINATION

We may modify, suspend, or terminate GoPlus (in whole or in part) at any time, with or without notice, subject to applicable law. If we discontinue GoPlus entirely, we will provide a pro-rated refund of any unused, prepaid Membership Fee. We may terminate your membership for breach of these GoPlus Terms, the Terms of Service, or applicable law; no refund will be issued in such cases.

9. PRIVACY

Your enrollment in and use of GoPlus are subject to our Privacy Policy, which describes how we collect, use, and disclose information.

10. DISCLAIMERS

GOPLUS AND THE BENEFITS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.  WE DO NOT GUARANTEE THE AVAILABILITY OF ANY PARTICULAR EVENT, TICKET, SELLER, VENUE, DELIVERY METHOD, OR BENEFIT.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GOTICKETS OR ANY OF ITS SUPPLIERS, LICENSORS, DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, PARTNERS, OR AGENTS BE LIABLE FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR OTHER SIMILAR DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH GOPLUS OR THESE GOPLUS TERMS.  WITHOUT LIMITING THE FOREGOING, GOTICKETS’ MAXIMUM AGGREGATE LIABILITY UNDER THESE GOPLUS TERMS SHALL BE LIMITED TO THE MEMBERSHIP FEES YOU PAID FOR GOPLUS DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS GREATER.

12. GOVERNING LAW; ARBITRATION; NO CLASS ACTIONS

These GoPlus Terms are governed by the same law specified in our Terms of Service. Dispute resolution (including binding arbitration, class action waiver, and jury trial waiver) shall be handled in accordance with the arbitration provisions in our Terms of Service (see Section 36). Nothing herein limits any non-waivable rights under applicable law.

13. MISCELLANEOUS

If any provision of these GoPlus Terms is found to be unlawful, void, or unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Any provisions intended to survive termination (including, without limitation, disclaimers and limitations of liability) will continue in effect following termination. Headings are for convenience only and do not affect interpretation.
